Before beginning your design, you will have the opportunity to purchase a limited license to use one of the symbols in our database in your logo. LogoYes retains copyrights to the original symbols, however the limited license allows you to use and display the symbol in your customized logo in advertising, promotional, signage, business stationery, and packaging materials. The symbols used in all preliminary designs which you do not select as the final version of your logo remain the full property of LogoYes, and you do not own a limited license to them. LogoYes retains the right to cancel orders and refund your money at any point in the development process. LogoYes also retains the right to modify or change this policy, at its sole discretion, at any time.

You cannot sell, assign, or otherwise transfer rights to the symbol alone, however, any trademarks rights you may eventually develop in the logo will be owned by you. The logo is considered to include the symbol and the text you display with the symbol.

These Conditions of Use are hereby incorporated by reference into your Licensing Agreement. If any provision in these Conditions of Use conflicts with any provision of your Licensing Agreement, the provisions herein shall be deemed amended to be consistent with the provisions in your Licensing Agreement.

Modification of these Conditions of Use

LogoYes reserves the right to change the terms, conditions, and notices at any time, and such modifications shall be effective immediately upon posting of such changes. You are therefore responsible for regularly reviewing these Conditions of Use and additional terms or notices posted on the LogoYes website. Your continued access of this website shall be deemed your conclusive acceptance of the modified agreement. When we make changes, we will also update the revision date at the top of the document.

Privacy

Please review our Privacy Policy, which also governs your visit to LogoYes, to understand our practices regarding the use and disclosure of your personal information.

License and Website Access

LogoYes grants you a limited license to access and make personal use of this website. You agree not to download (other than for page caching purposes) or modify the LogoYes website, or any portion of it, except as expressly provided in our on-line instruction for previewing logos, or pursuant to the License Agreement, or with the express written consent of LogoYes. You may not frame, or use any framing techniques to enclose the LogoYes trademark, logo, or other proprietary information (including images, text, flash movie, page layout, or form) without the express written consent of LogoYes. As a user, you may create a user identity for purposes of sharing and accessing your logo design(s) in progress. Your user identity will include certain personal information, such as your industry. If information will be shared with others, we will identify those fields. It is your decision on whether to share this information with other website users. You shall keep confidential, shall not disseminate, and shall use solely in accordance with these Conditions of Use, your user identity and password for the website. You shall immediately notify LogoYes if you suspect any loss or theft of these items or any unauthorized use of them or of the website. In such an event, we may impose additional security requirements on you and/or discontinue your access, at our sole discretion.

LogoYes reserves the right, at our sole discretion, to reject, cancel or terminate your access to the LogoYes website, your order for any product or service offered by LogoYes, including one pursuant to a License Agreement, at any time and without prior notice. You agree that LogoYes shall not be liable to you or any third party for any rejection, cancellation or termination of your access to the LogoYes website, your order or your License Agreement. If we reject, cancel, or terminate your order or License Agreement for a reason other than your breach or non-performance under your License Agreement, we will refund any prepayments made by you relating to the rejected, canceled or terminated order or License Agreement.

LogoYes will maintain and grant you access to your in-progress information from the date you initially accept the License Agreement until your logo is finished, for a period up to one year. If you have not accessed your in-progress information within one year’s time, the information may be deleted at our sole discretion, at a time of our choosing.

Disputes

Any dispute relating in any way to your visit or access of the LogoYes website or to the licenses or products or services you purchase through the LogoYes website shall be submitted to binding arbitration in Montgomery County, Texas, except that, to the extent you have in any manner violated or threatened to violate LogoYes' intellectual property rights, LogoYes may seek injunctive or other appropriate relief in any state or federal court in the state of Texas, and you irrevocably consent to personal and exclusive jurisdiction and venue in such courts. Under no circumstances shall the laws of any other state be applied, even where this result would be implicated by conflict of law principles. Arbitration under these Conditions of Use shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. Indemnification

What Information is LogoYes gathering about its visitors and how is it being used?

Every computer connected to the Internet is provided with a domain name (e.g. earthlink.net) and an IP Address (e.g. 192.164.13.145). When a visitor requests a page from within the LogoYes website, our Web Servers automatically identify and log the HTTP request that is made to our Web Server. This information reveals nothing personal about you. In fact, the only information that we automatically gather and log is as follows:

  • The IP Address of the Site that may have Referred you.
  • Your IP Address.
  • The Web Page that you may have linked to us from, if any.
  • The pages requested, and time and date of that request.
    The Product Identifier for Version and Make of Browser (e.g. Internet Explorer 4.5)

There is absolutely nothing special about the information just described, and the practice of collecting this data has been generally standardized by virtually every Web Server on the Internet today.

The purpose for this information is actually two-fold. One, LogoYes has found it advantageous to examine visitor traffic in its aggregate, so that we can ensure maximum compatibility for the various Browsers and Operating Systems on the computers of the users that visit our site. Additionally, as most businesses will agree, it is our desire to generate greater visitor traffic. By analyzing visitation patterns, referring URLs, and Search Engine terms, we can strategically enhance our exposure on the Internet.

LogoYes.com is a general audience website and we do not knowingly collect any personal information from children (those under the age of 13).

We retain information on logo designs in progress in password-protected files.

When you use LogoYes to access or review design projects, the software may record the date and time that you reviewed the designs.

In addition, LogoYes will not send you e-mail that you have not agreed to receive. If you are a member of our Mailing List, you may be contacted with announcements, news, portfolio additions, and new products or services. You have the option of "Unsubscribing" from our Mailing List at any time, thereby disabling any further such e-mail communication from being sent to you. If you wish to have specific communications with a member of the LogoYes staff, you will be required to provide specific information that will be routed to the appropriate contact within LogoYes.

What information does LogoYes collect when I purchase something?

If you purchase something, such as a license for use of a logo, or other products such as stationery, we need to obtain the appropriate information in order to complete the transaction. Depending upon the method of payment that you select and your location, the required information may vary. However, generally speaking we will need:
  • Your Name
  • Billing Address (for Credit Card Orders)
  • Shipping Address
  • E-Mail Address
  • Phone Number
  • Credit Card Number (for Credit Card Orders)
  • Expiration Date (for Credit Card Orders)
